1. All phonograms that are in the site www.tophit.ru Database as the MPEG 1 Layer 3 (mp3) audio-files can be used only for broadcasting by the radio stations and wired radio.
2. It is forbidden to transmit to the third party, sell, exchange, reproduce on any type of carriers, and allocate on the sites of broadcasting organizations or other sites in the Internet the phonograms that were got by broadcasting organizations from the www.tophit.ru Database.
3. Any type of the usage of the phonograms from the site www.tophit.ru Database except broadcasting by a radio station and wired radio is possible and legal by the preliminary written authorization of the right owners.
4. The usage of the phonograms from the site www.tophit.ru database and any other phonograms for broadcasting by a radio station and wired radio is legal on the assumption of payment of fees to the owners of copyright and neighboring rights.
5. The payment of fees to the owners of copyright and neighboring rights must be performed according to two independent Agreements: Agreement between broadcasting organization and the Russian Society of Authors (www.rao.ru) and Agreement between broadcasting organization and the Russian phonograph Association (www.fonogram.ru).
6. The breach of the law of Russian Federation "About copyright and neighboring rights" or any clause of this "Disposition" can be the reason of circumscription or the termination of the access of this organization to site www.tophit.ru Database without preliminary notification by the site administration.
